Coaching Terms of Service
Effective Date: 2nd October 2025
Welcome to JHMotiv.Shop (“we”, “our”, “us”). These Terms of Service (“Terms”) govern your booking and participation in our coaching services. By accessing or booking a session, you agree to be bound by these Terms. If you do not agree to these Terms, you must not book or attend any sessions.
1. The Service Provider and Eligibility
- Service Provider: The coaching services are provided by John Hummel, a sole proprietor operating under JHMotiv.Shop.
- Eligibility: You must be at least 18 years old or the age of majority in your jurisdiction to book or participate in sessions or have parental consent.
- Acceptance: By booking a session, you confirm that you have provided accurate and complete information and agree to comply with all applicable laws.
2. Booking, Scheduling, and Payment
- Booking Tool: All coaching sessions are scheduled via Calendly. By using this tool, you agree to Calendly’s own Terms of Use and Privacy Policy.
- Data Collection: As part of booking, we collect your name, email, phone number (optional), and responses to intake questions.
- Payment: Payment for sessions or packages must be made in full at the time of booking, unless a payment plan has been expressly agreed upon. All payments are processed securely via third-party payment providers.
3. Rescheduling, Cancellation, and Refund Policy
a. Rescheduling and Cancellation
- Free Rescheduling: You may reschedule your session free of charge by providing at least 24 hours’ notice via email to support@jhmotiv.shop.
- Late Rescheduling/Cancellation: Requests made with less than 24 hours’ notice will result in the forfeiture of that session. The session will be counted as completed and and no refund will be issued even at Coach’s Discretion.
- Coach’s Discretion: Notwithstanding the above, the Coach (John Hummel) reserves the exclusive right to waive the 24-hour notice requirement and allow a late reschedule or credit for a forfeited session in cases of documented emergency or at the Coach’s sole discretion. This is a rare exception and does not set a precedent for future late requests.
- No-Shows: If you do not attend a scheduled session without prior notice, the session will be forfeited, counted as completed, and no refund will be issued.
b. Money-Back Guarantee and Refund Policies
We offer distinct guarantee policies depending on the program structure. Please refer to your specific program agreement to confirm which policy applies.
Policy Option A: First Session Satisfaction Guarantee (Individual Sessions/Short Packages)
If, after completing your first scheduled coaching session, you feel the program is not the right fit, you may request a full refund of your program fee, subject to the following conditions:
- 100% Refund Window: You must notify us in writing (via email to support@jhmotiv.shop) of your cancellation intent within 7 calendar days of the completion time of your first session.
- Commitment: If a second coaching session is attended, or if the 7 Day window closes without a refund request, you are considered fully committed. No further refunds (full or partial) will be issued.
Policy Option B: Conditional Trial Guarantee (Long-Term Programs)
Our long-term programs require mutual effort. To qualify for a refund, you must actively demonstrate participation and implementation of the initial materials.
- Eligibility Window: You must request a refund in writing to support@jhmotiv.shop within 23 calendar days of your purchase OR prior to attending the third coaching session, whichever comes first.
- Required Proof of Work: Your refund request must include proof that you have attended the first two scheduled coaching sessions on time and completed the action items assigned during those sessions.
- Ineligible Requests: Requests made after the 23-day window, after attending the third session, or without the required proof of work will **not be eligible
4. Session Confidentiality and Technology
- Confidentiality: All information shared during coaching sessions (verbal or written) is treated as confidential. We will not disclose session content or personal details except as required by law.
- Session Recording: All sessions are conducted via Google Meets and are recorded and transcribed for accuracy, quality assurance, and action plan generation. By participating, you consent to the recording and transcription of the session.
- Action Plans: Transcripts are processed by Gemini to create summarized action plans, which will be sent to the email address you provided.
- Anonymized Use: We may use generalized, anonymized insights (themes, lessons, or strategies) from coaching sessions to create educational content. This information will never be linked to you or your business in a personally identifiable way.
- Disclaimer on Outcomes: While we aim to provide exceptional value, we do not guarantee specific results, outcomes, or financial achievements. Your success depends on your active participation and implementation.
5. Intellectual Property and Use
- Ownership: All content provided by us including coaching materials, action plans, frameworks, videos, and website content is the property of JHMotiv.Shop or its licensors and is protected by intellectual property laws.
- License to You: You are granted a non-exclusive, non-transferable license to use the coaching materials for your personal, non-commercial purposes only.
- Prohibited Use: You may not copy, reproduce, or redistribute any of our proprietary content without express written permission.
6. General Legal Terms
- Privacy: Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
- Termination: We may suspend or terminate your access to the coaching services or your account for any breach of these Terms, including failure to pay or abusive behavior.
- Governing Law: These Terms are governed by the laws of England and Wales, without regard to conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of England and Wales, located in London, for any dispute.
- Changes to Terms: We reserve the right to update or modify these Terms at any time. Changes will be posted here with an updated effective date. Your continued use of the service constitutes acceptance of the revised Terms.
7. Limitation of Liability and Disclaimer
Disclaimer of Warranties: Our services and all content are provided “as is” without warranties of any kind. We do not guarantee that the service will be error-free or uninterrupted, nor do we guarantee specific results or outcomes.
Limitation of Liability: In no event shall John Hummel (JHMotiv.Shop), its employees, or affiliates be liable for any indirect, consequential, or incidental damages, including lost profits or data, arising from your use of the coaching services. This limitation applies to the fullest extent permitted by law.
