Terms of service

Welcome to JH Motiv 3D Printing & Innovation (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website www.jh-motiv.square.site and our 3D printing, prototyping, and manufacturing services (collectively, the “Services”).
By placing an order, uploading a file, or using our website, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. General Services
1.1. We provide on-demand 3D printing, digital modeling, and related manufacturing services using FDM, SLA/Resin, and other additive manufacturing technologies.
1.2. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion, including orders that violate copyright laws or safety standards.

2. Custom Orders & File Submissions
2.1. Customer-Supplied Files: You are solely responsible for the accuracy, structural integrity, and printability of any 3D models, CAD files, or specifications (.STL, .OBJ, .3MF, etc.) you submit to us.
2.2. Intellectual Property Guarantee: By submitting a file to us, you represent and warrant that:

  • You own the copyright or hold an active commercial license for the model.
  • The print does not infringe upon any third-party patent, trademark, copyright, or trade secret.
  • 2.3. Prohibited Prints: We will not print weapons, firearm parts, dangerous items, illicit materials, or any content that promotes hate speech or illegal activity. We reserve the right to cancel any order containing prohibited content.

3. Intellectual Property Rights
3.1. Customer Designs: You retain full ownership and intellectual property rights to any proprietary CAD models or designs you upload. We will not sell, distribute, or publicly display your proprietary designs without your explicit written consent.
3.2. Company IP: All content on our website—including logos, text, code, graphics, and pre-designed product offerings—is the property of JH Motiv 3D Printing & Innovation and is protected by intellectual property laws.

4. Manufacturing Limitations & Materials
4.1. Additive Manufacturing Nature: 3D printing inherently creates minor layer lines, subtle visual artifacts, and slight surface variations. These are normal characteristics of the process and are not considered manufacturing defects.
4.2. Tolerances & Specs: Unless explicitly agreed upon in writing for a high-precision order, standard industry tolerances apply (typically $\pm 0.2\text{ mm}$ or $0.5\%$, whichever is greater).
4.3. Material Suitability: We provide general advice regarding material selection (e.g., PLA, PETG, Resin), but the customer is ultimately responsible for determining whether a printed part is suitable for their intended end-use environment.

5. Pricing, Payment & Quotes
5.1. Quotes: Instant quotes or custom quotes are valid for thirty (30) days from the date of issuance unless stated otherwise.
5.2. Payment: Full payment is required before production begins. Prices are subject to change without notice prior to order confirmation.
5.3. Taxes & Shipping: Customers are responsible for all applicable sales taxes, customs duties, and shipping charges calculated at checkout.

6. Lead Times, Shipping & Risk of Loss
6.1. Turnaround Times: Estimated lead times provided on our website or quote are estimates only and are not guaranteed. Production times may vary depending on file complexity, printer queue, and post-processing needs.
6.2. Shipping & Loss: Risk of loss and title for items pass to you upon our delivery of the package to the shipping carrier. We are not responsible for carrier delays, weather delays, or stolen packages.

7. Cancellations, Refunds & Failed Prints
7.1. Cancellations: Because custom 3D prints are manufactured on-demand, orders cannot be canceled once production (printing) has started.
7.2. Defective Items & Reprints: If your item arrives damaged in transit or suffers from severe structural manufacturing defects (e.g., major layer separation, total failure to match the CAD file within tolerances), you must contact us within fourteen (14) days of delivery at Support@JHMotiv.shop with clear photographs of the damage/defect.
7.3. Resolution: If we confirm a manufacturing failure on our part, we will, at our discretion, either reprint and reship the item free of charge or issue a store credit/refund. Refunds are not granted for customer-side design flaws or incorrect file uploads.

8. Limitation of Liability
8.1. To the maximum extent permitted by law, JH Motiv 3D Printing & Innovation shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from the use of or inability to use our printed parts.
8.2. Critical Applications Warning: Our printed parts are not certified for life-critical applications, medical devices, aviation, or high-risk structural environments unless explicitly certified under a separate, formal contract. Use of our prints in such applications is strictly at your own risk.

9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law principles.
